The Disability Discrimination Act 1995 ('the Act') introduced statutory employment/learning rights for people with disabilities. The Act makes it unlawful to discriminate in all aspects of employment and learning including recruitment, promotion, training, dismissal etc.

Under the employment/learning provisions it is unlawful for an employer/training provider to treat a person with a disability less favourably, for a reason relating to that person's disability, than an employer/learning provider would treat a non-disabled person, unless the treatment is justified.

It also requires employers/learning provider to make reasonable adjustment to its procedures, buildings, learning resources and, where appropriate, to individual posts if this will remove the disadvantage faced by an individual with a disability.

Under the provisions relating to access to goods, facilities and services, it is unlawful for someone providing services to the public to:

i) refuse to serve someone; or

ii) offer a person a service which is not as good as they would offer to other people; or

iii) provide a service on less favourable terms, for a reason relating to that person's disability, unless the treatment is justified.
